REVOLUTION RECORD CONVENTION 2024

REVOLUTION RECORD CONVENTION will be held Saturday July 13, 2024 at the Patterson-Appleton Arts Center in downtown Denton, Texas. It will host a full day of local, regional, and national vendors of collectible vinyl records, posters, memorabilia, and other forms of music media. There will be live entertainment, DJs, panel discussions, special appearances, food trucks, beer, and more! General admission into the record convention is FREE to all the public after early bird hour is complete.

RECORDS _ FESTIVAL HALL

Festival Hall will be the location that will house the record vendors as well as any memorabilia, clothing, posters, etc. There will be live DJs spinning records for everyone’s enjoyment.

Tape, tacks, screws, nails on walls are not allowed. There will be space for displays. WiFi available on site. Electricity upon request depending on availability.

PANELS _ EAST CRAFT ROOM

Panel discussions, live performances, special appearances, and listening stations will be held in the Crafts Room at PAAC, adjacent to Festival Hall.

FOOD & DRINKS

Food trucks will be stationed curbside outside, with a table area for sitting. Water, Soda, Beer, and Wine (cans only) will be available for purchase.

 

PATTERSON-APPLETON ARTS CENTER

The Patterson-Appleton Arts Center is located at 400 E. Hickory Street, Denton, TX 76201 and is home to the Greater Denton Arts Council, the Meadows Gallery, Gough Gallery, Dance Studio, East Craft Room, and Festival Hall. Free parking is located in the Arts Center parking lot and along Hickory St, with free overflow parking south of PAAC or the surrounding downtown area.

EARLY BIRDS

Attendees who would like first dibs on all the vendor booths can pay for early bird entrance. This will allow you to enter one full hour before general admission to the event opens.

This Early Bird Ticket also gains you entrance to our Revolution 7 Birthday Party at Rubber Gloves Rehearsal Studios July 20, starting at 8PM.

General admission into the record convention is FREE to all the public after early bird hour is complete. Terms of Attendence are listed below.


VENDORS

All records, memorabilia, clothing, and poster vendors will be located in Festival Hall at PAAC. Tape, tacks, screws, nails on walls are not allowed. There will be space for displays. WiFi available on site. Requests for electricity depend on availability at the time. $60 per 6ft table / chair.

HOTELS


Every dealer and vendor who attends Revolution Record Convention agrees to and is bound by the following rules and regulations and the Terms of Attendance located below.

Parking at the Patterson-Appleton Arts Center

Dealers can park free in the PAAC parking lot but there may not be enough parking for everybody in that area, so some may have to go into the overflow free parking area.

Dealer Badges Per Table

A dealer who purchases 1 table, receives up to 2 dealer badges. For each additional table (2,3,4, etc) we can supply 1 additional badge if needed. Please contact us if you have any questions. Also please understand we have to tightly control the number of dealer badges we distribute, for security (and other) reasons.

Wall rule

Nothing can be taped or attached to the wall area . If you need stronger attachments either bring your own pegboard backing to lean against the wall.

Table locations

The key to any location request is in sending the vendor form back quickly. Requests for particular locations will be considered as Revolution Record Convention organizes the Event layout. No location is guaranteed but we will try to accommodate all requests.

Theft

Revolution Record Convention is not repsonsible for any stolen items. You can find thieves at any record show, large or small. A dealer’s best defense is paying attention to business, i.e watch your table! And don’t leave a $500 record on the front of your table. If you have to leave your table, cover it up with a sheet or blanket. If you observe anyone with sticky fingers grabbing records, don’t be a hero. Make sure of your facts then talk to one of Revolution Record Convention workers and tell us, we’ll take it from there. We have a very good security staff that can handle anything.

Refunds

If something happens that makes your attendance at the show impossible, and you have already paid for a table, just let us know as soon as possible and if we can resell your table, you will receive a refund. If we cannot resell the table , than we can’t give you a refund, but we almost always have been able to resell a table. It’s always about the timing, so let us know ASAP when your show attendance is in doubt.

Security

A Denton Police Officer will be monitoring the parking lot and room during the show. 

Dealer Responsibility

Dealers are responsible for what is sold at their tables. Any customer who requests a refund under reasonable circumstances should be cheerfully complied with. An attitude of “Let The Buyer Beware” will not be tolerated at this show and we will ban any Dealer who violates this rule.

Prohibited Materials and Recordings

It is the strict policy of Real Waves Radio Network that no illegal, counterfeit, bootleg or obscene recordings or materials will be distributed or made available at Revolution Record Convention. All recordings and materials to be offered at Revolution Record Convention must be in compliance with applicable copyright laws, as well as the laws of the State Of Texas.

No Smoking

Smoking is not allowed anywhere in the entire building. 

Food / Alcohol

There will be concession stand with food, drinks, beer, and wine. Please no outside alcohol in the building.

Assistants and Early Admission

Each dealer is allowed one assistant per table. Anyone else who wants to get in early can do so by purchasing an early shopper admission.

Distributing flyers at the show

Any flyers or materials that are distributed to dealers or customers at the show must be cleared by the Real Waves Radio Network. We're usually fine with helping promote other record shows (as long as they aren't in Denton) and various other things. We want our dealers to benefit from interacting with customers, however we ask that you get permission for distributing leaflets or flyers.

SHOW RULES


This Application and Contract for Exhibit Space (this “Contract”), by and between Real Waves Radio Network (“Revolution Record Convention”) and the Dealer or entity (“Dealer”) designated in this Contract’s application section (“Application”), governs Dealer’s rental and use of exhibit space and/or other participation, as specified in the Application (“Participation”) in Revolution Record Convention (the “Event”)

LOCATIONS AND DATES:

The Event and Dealer’s Participation are scheduled for the locations and dates specified in the Application. Dealer acknowledges and understands that the locations, hours, or dates may change and the Event and/or Dealer’s Participation in the Event may be rescheduled. Revolution Record Convention will attempt to provide reasonable notice to Dealer of any such changes.

ACCEPTANCE OF CONTRACT:

This Contract will only become binding when it is accepted by Real Waves Radio Network. Real Waves Radio Network may accept this Contract by (a) countersigning this Contract; or (b) sending you confirmation of acceptance by US mail or email. Real Waves Radio Network reserves the right, at its sole discretion, to decline acceptance of any Contract.

PARTICIPATION ALLOCATIONS:

Revolution Record Convention will attempt to assign any Participation space/location requested in the Application in the order in which Contracts are received. If Dealer’s choice(s) of Participation space/location are not available, Revolution Record Convention will attempt to assign what it considers to be an appropriate space/location. Revolution Record Convention reserves the right, at its sole discretion, to designate Participation space/location or make changes in the location, size, layout, arrangement, time and display limits of the Participation. POSITIONING OF TABLE LOCATIONS IS AT REVOLUTION RECORD CONVENTION’S SOLE DISCRETION EXCEPT WHERE A REQUEST FOR SPECIFIC PREFERRED POSITION IS AGREED TO BY REVOLUTION RECORD CONVENTION IN WRITING.

PARTICIPATION FEES:

The fees for Dealer’s Participation in the Event (“Fees”) shall be as designated in the Application. For raw exhibit space, the Fee only includes table space and any items specifically designated in the Application, such as electricity, if applicable. All other expenses are the responsibility of Dealer. All Fees are deemed fully earned and non- refundable when the Contract is accepted, except as otherwise provided herein.

PAYMENT:

Unless otherwise specified in this Contract, payment of the Fees shall be made in U.S currency by credit card payment, or by bank transfer payable to Real Waves Radio Network, and shall be due immediately during online registration period.

DEALER MATERIALS:

Any promotional and/or presentation materials to be provided by Dealer in connection with this Contract will be provided in a manner and format designated by Revolution Record Convention. Dealer’s materials, including flyers or other materials, are subject to Revolution Record Convention’s approval. Revolution Record Convention shall have the right to reproduce, promote, distribute and otherwise use these materials in connection with the Event. Revolution Record Convention is not granted any other rights to Dealer’s materials, and acknowledges that it shall not gain any proprietary interest in Dealer’s materials. Dealer represents and warrants that the materials do not and will not infringe on any third-party rights, including, without limitation, copyright, patent, trade secret, trademark and rights of publicity or privacy, and are not false, misleading, deceptive, obscene or defamatory.

TRADEMARKS:

Revolution Record Convention shall have the right to use Dealer’s trademarks to promote Dealer’s participation in and sponsorship of the Event, and to fulfill its obligations under this Contract. Any such use shall be in compliance with Dealer’s relevant trademark or corporate identity guidelines, and all goodwill shall inure to the benefit of Dealer. Revolution Record Convention is not granted any other rights to Dealer’s trademarks, and acknowledges that it shall not gain any proprietary interest in Dealer’s trademarks. Dealer shall have the right to use Revolution Record Convention’s trademarks that are associated with the Event only to promote Dealer’s Participation in the Event. Any such use shall be in compliance with Revolution Record Convention’s relevant trademark or corporate identity guidelines, and all goodwill shall inure to the benefit of Revolution Record Convention. Dealer is not granted any other rights to Revolution Record Convention’s trademarks, and acknowledges that it shall not gain any proprietary interest in Revolution Record Convention’s trademarks.

CANCELLATION BY DEALER:

Dealer’s cancellation of all or part of its Event Participation, as contracted for herein, must be sent in writing to Revolution Record Convention and is only effective upon Revolution Record Convention’s actual receipt. Dealer’s failure to occupy exhibit space at the start of an Event constitutes Dealer’s cancellation for that Event. If Dealer cancels, Revolution Record Convention shall have the right, but not the obligation, to replace Dealer with another participant. If Dealer cancels, Dealer shall be liable for one hundred percent (100%) of the Fees for the canceled Participation, provided however, if Revolution Record Convention is able to replace Dealer with another participant and/or re-let Dealer’s cancelled space/table, Revolution Record Convention shall provide Dealer with a refund of any applicable Fees paid by Dealer, less Revolution Record Convention's cost to find the replacement. Dealer acknowledges that ascertaining damages incurred by Revolution Record Convention if Dealer cancels its Participation is difficult, and that the Fees owed or retained under this Agreement after cancellation represent a fair and agreed measure of compensation and are not to be deemed or construed as a penalty or forfeiture.

CANCELLATION BY REVOLUTION RECORD CONVENTION:

Revolution Record Convention reserves the right to cancel the Event or to terminate this Contract or Dealer’s Participation in all or part of the Event for any reason at any time upon written notice to Dealer. Upon Revolution Record Convention’s cancellation or termination, its sole liability to Dealer, and Dealer’s exclusive remedy, shall be a refund of the Fees paid by Dealer under this Contract for the Event in which Dealer is unable to participate due to such cancellation or termination.

FORCE MAJEURE:

NEITHER PARTY SHALL BE RESPONSIBLE FOR ANY LOSS OR DAMAGE RESULTING FROM FAILURE TO PERFORM UNDER THIS CONTRACT OR TO CONDUCT AN EVENT AS CURRENTLY SCHEDULED IN WHOLE OR PART AS A RESULT OF RIOT, STRIKE, LABOR DISPUTE, ACTS, REGULATIONS OR ORDERS OF GOVERNMENTAL AUTHORITIES, CIVIL DISORDER, ACT OF WAR, ACT OF TERRORISM, FAILURE OF FACILITIES, EARTHQUAKE, STORM, FIRE, FLOOD, OR OTHER ACTS OF GOD, OR ANY REASON OF ANY KIND WHATSOEVER BEYOND THE REASONABLE CONTROL OF THAT PARTY. NOTWITHSTANDING ANY OTHER TERMS OF THIS CONTRACT, IF AN EVENT IS CANCELLED BY REVOLUTION RECORD CONVENTION AND NOT RESCHEDULED IN CONNECTION WITH A FORCE MAJEURE EVENT, REVOLUTION RECORD CONVENTION’S SOLE LIABILITY TO DEALER, AND DEALER’S EXCLUSIVE REMEDY, SHALL BE A REFUND OF THE FEES FOR THAT EVENT PAID BY DEALER UNDER THIS CONTRACT LESS A PRO RATA RATE ADJUSTMENT BASED ON COSTS INCURRED BY REVOLUTION RECORD CONVENTION IN CONNECTION WITH THE CANCELLED EVENT.

INSTALLATION AND DISMANTLE:

All displays and table exhibits must be installed before, occupied during, and dismantled after the Event in accordance with the schedule provided by Revolution Record Convention. Materials not removed from the exhibition area by Dealer as specified by Revolution Record Convention will be removed by Revolution Record Convention at Dealer's expense and liability. 

USE OF SPACE:

Dealer may not sublet, assign, or apportion any part of the exhibit space contracted for herein, nor represent, advertise, distribute literature for, or otherwise promote the products or services of any other firm or individual except as approved in writing by Revolution Record Convention. Dealer may not display outside the confines of its assigned exhibit space.

CONDUCT OF PARTICIPATION:

Dealer shall conduct its Participation in a decorous manner in order not to be objectionable to Revolution Record Convention, the location at which the Event is taking place (the “Event Center”), other exhibitors, or the public. Revolution Record Convention reserves the right to restrict or prohibit exhibits which, because of noise, method of operation, content, safety, or any other reason, are objectionable to Revolution Record Convention or otherwise detract from or are out of keeping with the character of the Event. Revolution Record Convention may prohibit installation or request removal or discontinuance of any exhibit or promotion that, if continued, departs substantially from the design and description given advance approval. Revolution Record Convention reserves the right to close, remove or require changes in Dealer’s exhibit and to remove any of Dealer's personnel, agents, representatives, independent contractors, invitees or guests if the exhibit or individuals are deemed by Revolution Record Convention, in its sole discretion, to be detrimental to Revolution Record Convention, the Event, the Event Center, other exhibitors, or the public. Dealer shall adequately staff its exhibit during all Event hours. Dealer agrees to cooperate with Revolution Record Convention and other exhibitors, especially during periods of ingress and egress, in order to make mutual use of the facilities harmonious and agreeable. If Dealer or its representatives fail to observe the terms and conditions of this Contract or, in the reasonable opinion of Revolution Record Convention, conduct themselves unethically or detrimentally to Revolution Record Convention, Dealer may be dismissed from the Event without refund or other appeal.

CARE OF PREMISES:

DEALER SHALL NOT MARK, DEFACE OR OTHERWISE DAMAGE ANY FURNISHINGS OR EQUIPMENT THAT IS PROVIDED, INCLUDING BUT NOT LIMITED TO WALLS OR THE PREMISES. DEALER MAY NOT TAPE OR ATTACH ANYTHING TO THE WALL AREAS. DEALER SHALL RETURN ALL FURNISHINGS AND EQUIPMENT, AND THE PREMISES IN AS GOOD CONDITION AS THEY WERE RECEIVED. DEALER SHALL BE LIABLE FOR ANY DAMAGE CAUSED BY ITS FAILURE TO ADHERE TO THIS PROVISION.

CONDITION OF PREMISES:

Any space provided to Dealer under this Contract, including without limitation, tables and/or chairs (“Space”), is licensed and provided on an “AS IS” basis. Revolution Record Convention shall not be liable for preexisting conditions of the Space or for conditions arising during the period of the license or Dealer’s use.

INVITEES:

Anyone visiting, viewing or otherwise participating in the Space is deemed to be the invitee or licensee of Dealer while so visiting, viewing or otherwise participating in Dealer’s exhibit or Space, rather than the invitee of Revolution Record Convention or the Event Center.

EVENT BADGES:

Dealer personnel, agents and representatives must wear identification badges while on the exhibit floor. A Dealer that purchases one (1) table shall receive two (2) identification badges. For each additional table, Dealer will be provided with one (1) additional identification badge upon request.

ASSISTANTS AND EARLY ADMISSION:

Dealer is allowed one (1) assistant per table. For any additional Dealer personnel who need early admission to the Event, Dealer must purchase an early shopper admission.

DISPLAYS AND PROMOTIONAL DISTRIBUTION:

At its sole discretion, Revolution Record Convention may withhold or withdraw permission to display items or distribute souvenirs, advertising or any other material.

AVAILABLE SERVICES:

Revolution Record Convention will designate independent contractors (“Event Contractors”) to make certain services available (e.g., drayage, machine moving, cartage, machinery erection, furniture, signs). The specific services and Event Contractors, and their prevailing rates will be listed in the exhibitor manual to be issued separately. Revolution Record Convention assumes no responsibility or liability for any of the services performed or materials delivered by any Event Contractor. Arrangements for these services and payments shall be made directly between Dealer and the Event Contractors. Use of any contractor other than an Event Contractor shall require the advance written consent of Revolution Record Convention.

INSURANCE:

Dealer is solely responsible for its personnel, employees, agents, representatives, and property, and should have sufficient insurance to cover against loss, theft, damage or destruction of goods, and injury, including death, to its personnel, employees, agents or representatives. Dealer must obtain and carry a minimum of $1,000,000 per occurrence limit for Commercial General Liability Insurance including bodily injury and property damage, $1,000,000 limit for Commercial Property Coverage covering real and personal property and inland transit insurance, and $1,000,000 limit Worker’s Compensation. The insurance is to cover the full period of occupancy of the Space and, except for the Worker’s Compensation policy, shall name Revolution Record Convention as an additional insured. Dealer shall provide Revolution Record Convention and the Event Center with a certificate of insurance evidencing such coverage upon request.

SECURITY:

Revolution Record Convention will provide security personnel in the Event Center during the Event. If Dealer suspects any of its merchandise has been stolen by an attendee, Dealer shall notify such security personnel and provide as much detail as possible to such security personnel. The furnishing of such security service shall not be construed to be any assumption of obligation or duty with respect to the protection of the property of Dealers by Revolution Record Convention; such obligation and duty shall at all times remain in the sole possession, custody, and responsibility of each Dealer.

OTHER RULES AND REGULATIONS; WARRANTY:

Dealer shall comply with all applicable laws, rules, regulations, ordinances, codes and statutes with respect to the conduct of its exhibit. Dealer represents and warrants that all recordings and materials offered for sale at the Event are in compliance with applicable copyright laws as well as the laws of the State of Texas. Dealer shall also comply with the applicable Event rules, the exhibitor manual, if one is provided, and all reasonable requests of Revolution Record Convention and the Event Center with respect to the conduct of its exhibit. Revolution Record Convention and the Event Center may issue further rules and regulations governing the Event or use of the Event Center facilities from time to time. Dealer agrees to abide by all such rules and regulations.

TAXES AND LICENSES:

Dealer is solely responsible for obtaining any license(s) and/or permit(s) associated with its Participation in the Event. Dealer is solely responsible for the payment of all taxes (including sales and use taxes), license fees, or other charges applicable to its Participation in the Event, including any taxes collected by Revolution Record Convention on Dealer’s behalf.

LIMITATION OF LIABILITY:

REVOLUTION RECORD CONVENTION SHALL NOT BEAR ANY RESPONSIBILITY FOR THE SAFETY OF DEALER, ITS PERSONNEL, EMPLOYEES, AGENTS OR REPRESENTATIVES OR PERSONAL PROPERTY. REVOLUTION RECORD CONVENTION SHALL NOT IN ANY EVENT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR DAMAGES FOR LOSS OF PROFITS, REVENUE, DATA, OR DATA USE, WHETHER IN AN ACTION IN CONTRACT OR TORT OR OTHERWISE, EVEN IF IT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. REVOLUTION RECORD CONVENTION IS NOT LIABLE FOR ANY ERRORS IN ANY LISTINGS OR DESCRIPTIONS ASSOCIATED WITH THE EVENT, OR FOR OMITTING DEALER FROM THE EVENT SHOW GUIDE OR OTHER EVENT MATERIALS. THE TOTAL LIABILITY OF REVOLUTION RECORD CONVENTION FOR DAMAGES HEREUNDER SHALL IN NO EVENT EXCEED THE AMOUNT OF FEES PAID BY DEALER UNDER THIS CONTRACT AND NOTWITHSTANDING THE FAILURE OF ESSENTIAL PURPOSE OF ANY REMEDY.

INDEMNIFICATION:

Dealer shall defend, indemnify and hold harmless Real Waves Radio Network, its parent, subsidiary, and affiliate companies, and each of their officers, directors, employees, equity holders, agents and representatives from any losses, liabilities, damages, demands, suits, causes of action, judgments, costs or expenses (including court costs and reasonable attorneys’ fees) arising out of or due to: (a) the construction or maintenance of Dealer’s exhibit; (b) the negligence or willful misconduct of Dealer, or its personnel, employees, agents or representatives; (c) Dealer’s materials distributed in connection with the Event, including but not limited to Real Waves Radio Network’s use of the materials; or (d) Dealer’s breach of any commitment made in this Contract. Dealer agrees that a party that is being defended hereunder (the “Defended Party”) shall have the right to approve any counsel retained to defend any demand, suit or cause of action in which it is a defendant, such approval not to be unreasonably withheld. Dealer agrees that the Defended Party shall have the right to control and participate in the defense of any such demand, suit or cause of action concerning matters that relate to the Defended Party, and that such suit will not be settled without the Defended Party’s consent, which consent shall not be unreasonably withheld. If, in the Defended Party’s reasonable judgment, a conflict exists in the interests of the Defended Party and Dealer in such demand, suit or cause of action, the Defended Party may retain its own counsel whose reasonable fees shall be paid by Dealer.

NO ASSIGNMENT:

Dealer may not assign this Contract to any third party without the written consent of Revolution Record Convention.

AUTHORIZATION:

Dealer authorizes Revolution Record Convention to provide contact information, including its address, phone number, fax number, email address and contact person, to the Event Centers and Event Contractors. Dealer authorizes Revolution Record Convention to record Dealer’s participation in the Event, including participation by Dealer’s personnel, agents or representatives, and create transcriptions and derivative works therefrom in any medium. Dealer authorizes Revolution Record Convention to use, reproduce, copyright, translate, distribute, transmit, and publicly perform any such recordings, transcriptions or derivative works in connection with the Event. Notwithstanding the above, Revolution Record Convention shall not edit, alter or otherwise modify any recordings of presentations from Dealer in a manner that mischaracterizes the content or reflects negatively on Dealer. Dealer agrees to execute any additional releases presented by Revolution Record Convention in connection with these authorizations, and hereby waives any statutory restriction on waivers of future claims or moral rights.

MAILINGS/CONTACT LISTS:

Notwithstanding any other terms or conditions of this Contract: (a) all mailings provided hereunder shall be limited to individuals that have opted-in to receiving such mailings; and (b) all contact lists provided hereunder shall be limited to individuals that have opted-in to having their contact information provided to the party receiving the contact information. If Revolution Record Convention provides Dealer with the contact information of Event attendees who have opted-in to receiving marketing from Dealer, Dealer will ensure that it uses such information in compliance with applicable laws, including the U.S. CAN-SPAM Act.

COLLECTION OF INFORMATION:

In the event that Dealer chooses to collect information from Event attendees (via electronic means or otherwise), Dealer will do so in a manner that clearly identifies Dealer, and not Revolution Record Convention, as the entity collecting the information and will comply with applicable laws.

GOVERNING LAW; JURISDICTION:

This Contract, and all matters arising out of or relating to this Contract, shall be governed by the procedural and substantive laws of the State of Texas, USA without regard to the conflict of laws provisions of any state or jurisdiction. Any legal action relating to this Agreement shall be instituted in a state or federal court in Denton, Denton County, Texas and each party hereby submits to the exclusive jurisdiction of, and agrees that venue is proper in, these courts in any such legal proceeding.

NO WAIVER; SEVERABILITY; SURVIVORSHIP:

Any express waiver or failure to exercise any right under this Contract will not create a continuing waiver or any expectation of non-enforcement. If any provision of this Contract is held invalid by any law or regulation of any government or by any court or arbitrator, such invalidity will not affect the enforceability of the other provisions. Rights and obligations under this Contract, which by their nature should survive, will remain in effect after termination or expiration of this Contract.

ENTIRE AGREEMENT:

This Contract, the Application, exhibitor manual and applicable rules constitute the complete agreement between the parties and supersedes all prior or contemporaneous agreements or representations, written or oral, concerning the subject matter hereof. This Contract may not be modified or amended except in a writing signed by a duly authorized representative of each party.

Please read these terms of attendance very carefully before purchasing a ticket or attending an event produced by Real Waves Radio Network (“KUZU”) called Revolution Record Convention (“Event”). These terms of attendance (“Agreement”) govern your access to the Event. This Agreement between you (hereinafter sometimes “you” or “Attendee” or “Holder”) and Real Waves Radio Network (“Revolution Record Convention”) is subject to change by us as described below. By clicking the “I Agree” button below, you (i) accept this Agreement; (ii) agree to be bound by these terms and conditions; and (iii) have entered into a binding agreement between you and Real Waves Radio Network.

All sales made through the Revolution Record Convention website or through a third-party ticketing provider are subject to the terms of this Agreement.

TERMS OF SALE

Tickets sold grant to the Holder only a revocable license to the bearer that may be revoked at any time for any reason. Resale or attempted resale of any ticket issued hereunder at a price higher than the face value appearing thereon is grounds for seizure and cancellation without compensation. Holder assumes all risk or danger incidental to the attraction, whether occurring prior to, during, or subsequent to, the actual attraction. The terms of sale of each ticket issued pursuant to a transaction are subject to any and all terms imposed by the Revolution Record Convention website or the terms of a third-party ticketing provider. In order to be admitted to an event, each Holder must present the original ticket in its original, undamaged, unaltered form, or other acceptable electronic form, to the applicable venue at the appropriate time. Entry may be refused for various reasons, including misconduct, intoxication, etc., as determined by Revolution Record Convention.

PRIVACY POLICY

You expressly consent to terms of Revolution Record Convention Privacy Policy, located below and incorporated herein by reference, including, without limitation, its consent for Real Waves Radio Network to send text messages to your phone number and email you marketing messages concerning future events.

RELEASE OF LIABILITY

THE HOLDER EXPRESSLY ASSUMES ALL RISK AND DANGER ARISING FROM OR INCIDENTAL TO THE EVENT FOR WHICH THE TICKET IS ISSUED OR WHICH YOU ATTENDED, INCLUDING, WITHOUT LIMITATION, THE RISK OF CONTRACTING AN INFECTIOUS DISEASE, WHETHER SUCH RISKS OCCUR PRIOR TO, DURING, OR SUBSEQUENT TO THE ACTUAL EVENT. THE HOLDER EXPRESSLY RELEASES REVOLUTION RECORD CONVENTION, THE EVENT FACILITY, MANAGEMENT, PROMOTERS, PARTICIPANTS, PERFORMERS, ARTISTS, AND THE TICKETING AGENCY AND/OR TICKETING SERVICES PROVIDER AND ALL OF THEIR OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, REPRESENTATIVES, AND AGENTS (THE “EVENT RELEASEES”), FROM ANY AND ALL CLAIMS THAT THE HOLDER HAS OR MAY HAVE THAT ARISE FROM OR ARE INCIDENTAL TO THE EVENT OR THE HOLDER‘S ATTENDANCE AT THE EVENT, INCLUDING ANY CLAIMS ARISING OUT OF THE NEGLIGENCE OF REAL WAVES RADIO NETWORK OR ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, REPRESENTATIVES, OR AGENTS.

WITHOUT LIMITING THE GENERALITY OF THE FORGOING, THE HOLDER SPECIFICALLY ACKNOWLEDGES THE CONTAGIOUS NATURE OF COVID-19, THAT NEITHER REAL WAVES RADIO NETWORK NOR ANY OTHER EVENT RELEASEE, CAN PREVENT THE HOLDER FROM BEING EXPOSED TO, CONTRACTING, OR SPREADING COVID-19 WHILE ATTENDING THE EVENT. THE HOLDER HEREBY SPECIFICALLY ACCEPTS THE RISK OF CONTRACTING COVID-19 FOR HIMSELF OR HERSELF AND/OR HIS OR HER FAMILY BY ATTENDING THE EVENT.

THE HOLDER HEREBY EXPRESSLY FOREVER RELEASES AND WAIVE HOLDER‘S RIGHT TO BRING SUIT AGAINST THE EVENT RELEASEES IN CONNECTION WITH EXPOSURE, INFECTION, AND/OR SPREAD OF COVID-19 RELATED TO HOLDER‘S ATTENDANCE AT THE EVENT.

THE HOLDER UNDERSTANDS THAT THE WAIVERS CONTAINED IN THIS SECTION MEANS THE HOLDER GIVES UP THE HOLDER‘S RIGHT TO BRING ANY CLAIMS INCLUDING FOR PERSONAL INJURIES, DEATH, DISEASE OR PROPERTY LOSSES, OR ANY OTHER LOSS, INCLUDING BUT NOT LIMITED TO CLAIMS OF NEGLIGENCE AND GIVE UP ANY CLAIM THE HOLDER MAY HAVE TO SEEK DAMAGES, WHETHER KNOWN OR UNKNOWN, FORESEEN OR UNFORESEEN.

NO REFUNDS OR EXCHANGE

EVENT DATE AND TIME IS SUBJECT TO CHANGE. ALL RIGHTS RESERVED. IF THE EVENT FOR WHICH THIS TICKET IS ISSUED IS RESCHEDULED OR CANCELLED, THE HOLDER SHALL NOT BE ENTITLED TO A REFUND EXCEPT AS OTHERWISE REQUIRED BY LAW. INSTEAD, THE HOLDER SHALL HAVE THE RIGHT, EXCEPT AS OTHERWISE PROVIDED, (1) IF THE EVENT IS RESCHEDULED TO A DATE AND TIME WITHIN TWELVE MONTHS OF THE DATE AND TIME ORIGINALLY SCHEDULED, TO USE THIS TICKET TO ATTEND THE EVENT AT THE RESCHEDULED DATE AND TIME, OR (2) IF THE EVENT IS NOT RESCHEDULED WITHIN TWELVE MONTHS OF THE DATE AND TIME ORIGINALLY SCHEDULED, TO EXCHANGE THIS TICKET FOR ANOTHER TICKET, COMPARABLE IN PRICE AND SEATING LOCATION, TO ANOTHER EVENT THAT IS DESIGNATED BY REVOLUTION RECORD CONVENTION AS THE OFFICIAL REPLACEMENT EVENT FOR THE CANCELLED EVENT.

Tickets are not subject to any refunds, bear no cash value, and are not redeemable for cash. Artist and set times are subject to change without notice. Tickets are not subject to exchange except as expressly provided herein. If issued as a complimentary ticket, a ticket is not exchangeable or redeemable for another ticket to any other event or performance or for any other consideration, monetary or otherwise. Tickets obtained from unauthorized sources may be counterfeit and worthless. Tickets cannot be replaced if lost, stolen or destroyed, and are valid only for the event and seat for which they are issued. It is unlawful to reproduce a ticket in any form. Real Waves Radio Network reserves all rights not expressly granted to the Holder by these terms.

RESERVATION OF REAL WAVES RADIO NETWORK’S RIGHTS

Real Waves Radio Network reserves the right to refuse admission to or eject any person whose conduct or hygiene is deemed by Real Waves Radio Network, at Real Waves Radio Network’s sole discretion, to be undesirable, including (but not limited to) disorderly conduct, use of vulgar or abusive language, or failure to follow Real Waves Radio Network or facility rules and directions. Undesirable conduct of any of the types expressly listed above will automatically terminate any license and all rights of the Holder. The exercise of Real Waves Radio Network’s ejection rights hereunder does not entitle the Holder to a refund of the ticket price or any part thereof. A ticket is a revocable license and admission may be refused at Real Waves Radio Network’s discretion. Unlawful resale or attempted resale is grounds for seizure and cancellation of the ticket, without compensation, at Real Waves Radio Network’s discretion.

TRANSMISSION OR REPRODUCTION PROHIBITED

The Attendee agrees not to transmit or aid in transmitting any description, account, picture, or reproduction of the event, performance, exhibition or game for which this ticket is issued, without the appropriate permissions. The Attendee acknowledges that the event may be broadcast or otherwise publicized, and grants permission for Attendee’s image or likeness to be used in any live or recorded transmission or reproduction of such event, performance, exhibition or game in any medium or context for any purpose, including commercial or promotional purposes, without further authorization or compensation.

COMPLIANCE WITH FACILITY RULES

The Attendee agrees to comply with all local or facility rules that prohibit or limit alcoholic beverages, illegal drugs, controlled substances, cameras, recording devices, bundles and containers of any kind from being brought into the event premises.

TICKET PRICE

TICKET PRICE IS NONREFUNDABLE EXCEPT AS SPECIFICALLY PROVIDED IN THIS AGREEMENT.

RESELLING AND PROMOTIONAL USE PROHIBITED

The Holder agrees not to transmit, distribute, or sell (or aid in transmitting, distributing, or selling) in any media now or hereafter existing, any description, account, picture, video, audio or other form of reproduction of the event or any surrounding activities (in whole or in part) for the Event, without the express written approval of Real Waves Radio Network. Tickets may not be used for any form of commercial or trade purposes, including, but not limited to, advertising, promotions, contests or sweepstakes, without the express written consent of Real Waves Radio Network.

BREACH OF TERMS

Breach of any of the terms of this Agreement or the failure to comply with venue rules shall automatically terminate any rights that the Holder may have hereunder; shall render illegal and unauthorized the Holder’s use of the ticket for any purpose; and shall authorize Real Waves Radio Network to withdraw the ticket, refuse admission to the Event, or eject the Holder from the Event. Breach of any of the terms of this Agreement shall also subject the Holder to all legal remedies available to Real Waves Radio Network. Sale or attempted sale of a ticket is grounds for seizure or cancellation without refund or other compensation.

ENTRY SUBJECT TO SEARCH

The Attendee and the Attendee’s belongings may be searched upon entry into the Event, and the Attendee consents to such searches and waives any related claims that might arise against Real Waves Radio Network. If the Attendee elects not to consent to these searches, the Attendee will be denied entry into the Event.

CHOICE OF LAW

THIS AGREEMENT SHALL BE GOVERNED AND INTERPRETED BY THE INTERNAL LAWS OF THE STATE OF TEXAS WITHOUT REGARD TO THE CONFLICTS OF LAW PROVISIONS THEREOF. NOTWITHSTANDING THE FOREGOING, THE ARBITRATION AGREEMENT CONTAINED HEREIN SHALL BE GOVERNED BY THE FEDERAL ARBITRATION ACT.

DISCLAIMER OF WARRANTIES

THE EVENT AND SERVICES ARE PROVIDED “AS IS”, “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND EITHER EXPRESS OR IMPLIED. REAL WAVES RADIO NETWORK SHALL HAVE NO RESPONSIBILITY OR LIABILITY FOR ANY CONTENT, MATERIALS POSTED ON THE SITE OR SERVICES. REAL WAVES RADIO NETWORK MAKES NO GUARANTEES AS TO THE EVENT OR SERVICES. TO THE FULLEST EXTENT POSSIBLE PURSUANT TO THE APPLICABLE LAW, REAL WAVES RADIO NETWORK DISCLAIMS ALL WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT OR OTHER VIOLATION OF RIGHTS. THE EVENT OR THE SERVICES MAY BE SUBJECT TO LIMITATIONS, DELAYS, AND OTHER PROBLEMS INHERENT IN THE USE OF THE INTERNET AND ELECTRONIC COMMUNICATIONS. REAL WAVES RADIO NETWORK IS NOT RESPONSIBLE FOR ANY DELAYS, DELIVERY FAILURES, OR OTHER DAMAGE RESULTING FROM SUCH PROBLEMS, INCLUDING INTERNET CONGESTION, VIRUS ATTACKS, AND DENIAL OF SERVICE (DOS) ATTACKS.

LIMITATION OF LIABILITY

UNDER NO CIRCUMSTANCES, INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE, SHALL REAL WAVES RADIO NETWORK OR ITS THIRD PARTY LICENSORS BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES, INCLUDING, BUT NOT LIMITED TO, LOSS OF DATA OR PROFIT, ARISING OUT OF THE USE, OR THE INABILITY TO USE, THE MATERIALS ON THIS SITE OR THE SERVICE, EVEN IF REAL WAVES RADIO NETWORK HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND NOTWITHSTANDING THE FAILURE OF ESSENTIAL PURPOSE OF ANY REMEDY. REAL WAVES RADIO NETWORK’S AND ITS LICENSORS’ ENTIRE AND AGGREGATE LIABILITY, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, SHALL NOT EXCEED $100, EVEN IF REAL WAVES RADIO NETWORK HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND NOTWITHSTANDING THE FAILURE OF ESSENTIAL PURPOSE OF ANY REMEDY. IF YOUR USE OF MATERIALS FROM THIS SITE OR THE SERVICE RESULTS IN THE NEED FOR SERVICING, REPAIR OR CORRECTION OF EQUIPMENT OR DATA, YOU ASSUME ANY COSTS THEREOF. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.

ENTIRE AGREEMENT

This Agreement shall constitute the entire agreement between the parties regarding the subject matter hereof and supersede all proposals and prior discussions and writings between the parties with respect thereto. No failure or delay in enforcing any right or exercising any remedy will be deemed a waiver of any right or remedy. Each provision of this Agreement is a separately enforceable provision. If any provision of this Agreement is determined to be or becomes unenforceable or illegal, such provision shall be reformed to the minimum extent necessary in order for this Agreement to remain in effect in accordance with its terms as modified by such reformation.

ARBITRATION AGREEMENT

Any dispute, controversy or claim arising under, out of or relating to this Agreement and any subsequent amendments of this Agreement, including, without limitation, its formation, validity, binding effect, interpretation, performance, breach or termination, as well as non-contractual claims, shall be submitted to arbitration before the American Arbitration Association (“AAA”) in accordance with the AAA Commercial Arbitration Rules.  The place of arbitration shall be Denton, Texas. The language to be used in the arbitral proceedings shall be English.  The Parties may apply to any court of competent jurisdiction for a temporary restraining order, preliminary injunction, or other interim or conservatory relief as necessary, without breach of this Section and without abridgment of the powers of the arbitrator.  The arbitrator may award any form of individual or equitable relief, including injunctive relief. Any award will be final and conclusive to the Parties and may be entered in any court of competent jurisdiction.  You agree to the entry of injunctive relief to stop any lawsuit or to remove you as a participant in such a suit. By using the Site in any manner, you agree to this arbitration agreement. In doing so, YOU GIVE UP YOUR RIGHT TO GO TO COURT to assert or defend any claims between you and Revolution Record Convention. YOU ALSO GIVE UP YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION OR OTHER CLASS PROCEEDING. This provision preventing you from bringing, joining or participating in class action lawsuits is an independent covenant. You may opt-out of this Section by providing written notice of your decision within thirty (30) days of the date that you first use the Site.

All claims arising out of or relating to this Agreement, to the Services, or to your relationship with Real Waves Radio Network that, for whatever reason, are not submitted to arbitration will be litigated exclusively in the federal or state courts of Denton County, Denton, Texas, U.S.A. You and Real Waves Radio Network consent to the exercise of personal jurisdiction of such courts in the State of Texas and waive any claim that such courts constitute an inconvenient forum.

CONSENT TO ELECTRONIC COMMUNICATIONS

By clicking “REGISTER” or signaling assent through another manner such as purchasing a ticket, you consent to receive disclosures from Real Waves Radio Network electronically under the terms set forth in this Consent. You agree that we may provide electronically any and all communications concerning your tickets, the event and/or any payment plan you may enter into as well as any disclosures required by federal or state law (the “Disclosures”). Your consent applies not only to the tickets and any payment plan but also to any ancillary agreement related to these and to any future tickets or payment plans you may obtain through us.

To electronically receive and view and electronically save or print the Disclosures, you must have: a personal computer with Internet access; a widely-used, recent-generation web browser; and a printer, hard drive or other storage device. You represent that you have this hardware and software.

Prior to your purchasing the tickets or attending the Event, you may withdraw your consent to receipt of electronic disclosures by exiting the website. If you do this, you will not be able to purchase tickets from us. To withdraw your consent after this time, send an email stating that you withdraw your consent to receipt of electronic disclosures via the contact information in the Real Waves Radio Network Privacy Policy. Include your name and address in any such request. You have the option to receive any information that we have provided electronically in paper form at no cost to you.

By clicking “REGISTER” or signaling assent through another manner such as purchasing a ticket or attending the Event, you agree to these terms and conditions and you agree to the Arbitration Agreement, and the Consent to Electronic Contracting and Communications. If you do not agree to these terms and conditions, or the Arbitration Agreement, or the Consent to Electronic Contracting and Communications do not continue or click “REGISTER”.

Terms of Attendance


We are requiring dealers to read these rules and select the I HAVE READ AND AGREE on Vendor Form, or click CANCEL to cancel your application if you so choose.

Temperature Checks
All dealers and shoppers may have to have their temperature checked by facility personnel. Anyone whose temperature is too high will be asked to wait for a period of time and checked again before entering. Regardless of whether you've paid for a table, if you have a high temperature you will be denied entry.

Masks may be required at all times
All dealer and shoppers may be requested to wear masks at all times inside the building and during load-in / load-out. Masks will not be provided by Revolution Record Convention - you must bring your own.

Limited Shoppers Per Table
In order to keep crowds from forming, there might be limits as to the number of customers that can shop at a table at the same time.

COVID Test or Proof of Vaccination
Revolution Record Convention reserves the option to require dealers and / or shoppers to provide proof of COVID vaccination and / or a recent negative COVID test

Travel Restrictions
We are asking all international dealers to be aware if any travel restrictions are in place that would prohibit them from attending the show.

Show Cancelation
By agreeing to these rules you acknowledge and understand that due to circumstances beyond our control, the show could be canceled or postponed. If that happens, we will refund your payment.

Travel Insurance
For dealers with significant travel expenses, we encourage them to consider getting travel insurance to cover any of the unfortunate scenarios we've described above (or ones we haven't thought of).

COVID-19 Warning
COVID-19 is an extremely contagious disease that can lead to severe illness or even death. There is an inherent risk of exposure to COVID-19 existing in any public places where people are present. Although we and the venue may put in place preventative measures to reduce the spread of COVID-19 we cannot guarantee that you or your family will not be exposed to or contract COVID-19 while attending the event. You must follow all posted instructions while attending Revolution Record Convention.

By attending Revolution Record Convention, you voluntarily assume all risks related to exposure to COVID-19, accept full responsibility for any such injury to yourself or your family.

Changes to These Rules
If we need to add to, amend, or change these rules we will do so, in order to make the show safe and successful. We will make an effort to keep our dealers informed of any changes, but if there are new or additional rules you will be required to abide by them.

COVID Rules Agreement


INTRODUCTION

Real Waves Radio Network (“Revolution Record Convention” or “we” or “us”) has created this Privacy Policy in order to disclose its use of consumer data collected about you. This Privacy Policy is effective as of January 18, 2023. Any questions regarding this policy should be directed by email to admin@kuzu.fm. You may also contact Real Waves Radio Network at 317 S Elm St, Denton, Texas 76201. The following discloses Revolution Record Convention’s information gathering and dissemination practices for its tickets, social networking applications and website.

INFORMATION COLLECTED AND RECEIVED

Revolution Record Convention may collect or receive information about each person who registers with Revolution Record Convention website and/or applications including, but not limited to, business name, first and last name, email address, street address, occupation, and interests. Revolution Record Convention also collects information on the pages you access and other information you may volunteer, such as survey information.

Revolution Record Convention also collects and/or receives information regarding ticket purchasers either on its website or through a third-party ticketing company. Revolution Record Convention may also collect user location information, as further described in the “Global Positioning System” paragraph below.

USES OF INFORMATION

Revolution Record Convention uses the information that we and our service providers collect in order to provide you the services that you purchase and/or otherwise request.

Revolution Record Convention may also use your email address or phone number to provide you with transactional and marketing messages, including transactional messages concerning an event following a ticket purchase and marketing messages concerning future events. If you do not wish to receive these messages, please use the provided opt-out mechanism or contact us using the information at the bottom of this Privacy Policy.

If you purchase a ticket, use our text to search feature or another text messaging system, you expressly consent to allow Revolution Record Convention, either independently or through its service provider, to send text messages to your phone number.

WE WILL NEVER SELL YOUR EMAIL ADDRESS, OR ANY OTHER PERSONAL INFORMATION, FOR MONETARY CONSIDERATION TO ANY THIRD PARTY WITHOUT YOUR PERMISSION. EVER.

Revolution Record Convention reserves the right to transfer your personal information to a purchaser of the company or substantially all of its assets as a necessary part of that transaction.

Except as described in this section, we will not disclose your personal information to any third party without notifying you of our intent to share the information and giving you an opportunity to prevent your information from being shared.

From time to time, we may partner with companies based on the interests of our users. These partner companies will never see your email address or any other information that could identify you or be used to contact you directly.

Any exceptions to this policy of sharing your name, address or email address with a partner company will be done only with your permission.

Revolution Record Convention reserves the right to disclose information when required by law.

We use other companies to perform services as part of our operations. In the course of providing these services, those companies may have access to your personal information. Those companies must treat your information in accordance with either this Privacy Policy or their privacy policy. However, we will not be liable for any damages that may result from the misuse of your personal information by these companies.

Revolution Record Convention may use your IP address to help diagnose problems with Revolution Record Convention’s server and to administer Revolution Record Convention’s web site. Your IP address may also be used to help identify you and your online profile and to gather broad demographic information.

Revolution Record Convention site registration form requires users to give Revolution Record Convention contact information (such as your name and email address) and demographic information (such as your zip code, age, or income level). Revolution Record Convention uses your contact information from the registration form to send you information about Revolution Record Convention and promotional material from some of Revolution Record Convention’s partners. Your contact information may also be used to contact you when necessary. Revolution Record Convention may use demographic and/or profile data to tailor your experience on Revolution Record Convention website and/or applications, show you content that Revolution Record Convention thinks you may be interested in, and display content according to your preferences. The demographic and profile data will be shared with third parties ONLY on an aggregate basis. Furthermore, Revolution Record Convention shall have the right to retain records of all data pertaining to use of the website and applications including, but not limited to, usage, activity logs, and click-throughs. Revolution Record Convention may disclose such data to third parties provided it is grouped with other Revolution Record Convention users’s data and is presented in an aggregate form.

We may also disclose, on an anonymous basis, statements made by our users.

CHILDREN’S PRIVACY

We do not knowingly collect any information from anyone who we know to be under the age of 13. If you are under the age of 18, you should use this website only with the involvement of a parent or guardian and should not submit any personal information to us. If we discover that a person under the age of 13 has provided us with any personal information, we will use commercially reasonable efforts to delete such person's personal information from all Real Waves Radio Network systems.

GLOBAL POSITIONING SYSTEM

Global Positioning System (GPS) tracking technology may need to be enabled in Revolution Record Convention products and services in order to determine the location (latitude and longitude) of users of Revolution Record Convention products and services. This information is transmitted to Revolution Record Convention, Revolution Record Convention’s users, and temporarily stored by Revolution Record Convention. Revolution Record Convention does not provide this information to any other third party. This information is used in conjunction with Revolution Record Convention’s applications.

SECURITY

Revolution Record Convention uses industry-standard technologies when transferring and receiving consumer data exchanged between Revolution Record Convention and other companies to help ensure its security. This site has security measures in place to protect the loss, misuse and alteration of the information under Revolution Record Convention’s control. Revolution Record Convention’s servers are backed up regularly and protected by security systems. Please be aware, though, that despite our efforts, no security measures are perfect or impenetrable. We cannot ensure, and do not warrant or guarantee, that the information you transmit will remain secure, nor do we guarantee that this information will not be accessed, disclosed, altered, destroyed or used in an unauthorized manner.

COOKIES

Real Waves Radio Network may amend this policy at any time.
